Tell step daughter to speak with local Jag ASAP. They can only help one side in a divorce, and it’s first come first serve.


He’s gonna get 134’d, which is up to a year in the Brig, and a Dishonorable Discharge

In the Army, you typically just get booted with an Other Than Honorable. Still pretty screwed in the civilian world though.

Should he get booted, those kids just lost their healthcare. :(

Actually upon further reading that’s the max, generally you’ll get 6 months in the Brig, and a Bad Conduct Discharge(just as bad)

I have no clue how military health care benefits apply to family members, but I think I would prefer that he stays in so that child support & healthcare are a bit more certain. If he got a dishonorable, I would worry about his future ability to provide for his kids. Plus, if he's a lifer, the stepdaughter would be able to get some portion of his retirement.

We don't know much at this point other than stuff is settling out day-by-day.

 

I may have a trip to LA pretty soon. Our, (me and the W/G) thought is I fly out. They they home. When I get done. Grab the Kia Sorento and load it up and drive back to GA. They hang out with us until things get sorted out, over the summer.

Figure it out come August when more permeant things like kids' school kicks in.

That's gonna suck for him if they go down this road.

He's up for Gunny this year...

If he’s up for Gunny, he’s been in for more than 6 years. He’s entitled to... I forget the proper name, but it’s basically a court martial with no jury and average, non-legal officers and senior NCOs are the “judges”. Marines would provide him legal representation. Still a snowball in hell chance but it’s there.

DD, I’ve seen this thing many times sadly. If you have any questions or advice, feel free to PM me.

And I know this sounds sucky, but step daughter NEEDS to talk to every Jag office see can to block him from getting their help. Even if she plans on staying with him for now. Trust me 125% here. All she has to do is ask “what are my options for a divorce?” She’s doesn’t have to move forward with anything, but this will keep her from getting blindsided and not have cheap yet competent legal help should she have to make quick decisions. I’ve seen this too many times. Get her to Jag. Get her to every Jag. ASAP.

Seems kind of wierd that the military would even get involved. Guess it's normal, just seems strange. What a moron. Can't they just deny it? Unless there is a video or something...
